for use - Important legal information
I-MediCure provides its service on this website (“the Service”)
to you, subject to the following Conditions for Use ("Conditions"),
which may be updated by I-MediCure from time to time without notice
to you. You should review the Conditions periodically for changes.
The documents contained in the Service are presented for information
purposes only. The material is in no way intended to replace professional
medical care or attention by a qualified practitioner.
The materials in the Service cannot and should not be used as a
basis for diagnosis or choice of treatment. The materials are not
exhaustive, and the Service cannot always reflect all the most recent

2. Dealings
with advertisers and merchants
Your correspondence or business dealings with, or participation
in promotions of, advertisers and merchants found on or through
any of the services contained on the Service, including payment
and delivery of related goods or services, and any other terms,
conditions, warranties or representations associated with such
dealings, are solely between you and such advertiser or merchant.
To the fullest extent permitted by applicable law, you agree that:
(a) I-MediCure shall not be responsible or liable for any loss
or damage of any kind incurred as the result of any such dealings
or as the result of the presence of such advertisers and merchants
on the Service, and (b) any orders placed by you on, and any product
specifications and product availability appearing on, the Service
are subject to confirmation by, and the terms and conditions of
business of, the relevant merchant.

The Service may provide, or third parties may provide, links to
other World Wide Web sites or resources. Because I-MediCure has
no control over such sites and resources, you acknowledge and
agree that I-MediCure is not responsible for the availability
of such external sites or resources, and does not endorse and
is not responsible or liable for any content, advertising, products,
or other materials on or available from such sites or resources.
You further acknowledge and agree that I-MediCure shall not be
responsible or liable, directly or indirectly, for any damage
or loss caused or alleged to be caused by or in connection with
use of or reliance on any such content, goods or services available
on or through any such site or resource.
4. Proprietary
rights
You acknowledge and agree that the Service and any information
presented to you through the Service contains proprietary information
that is protected by protected by copyrights, trademarks, service
marks or other proprietary rights and laws, applicable intellectual
property and other laws. Except as expressly authorised by I-MediCure
or our relevant licensors, you agree not to modify, rent, lease,
loan, sell, distribute or create derivative works based on the
Service in whole or in part.
5. Limitation
of liability
To the fullest extent permitted by applicable laws, and except
in respect of death or personal injury arising from I-MediCure’s
negligence, I-MediCure hereby excludes liability for any claims,
loss, demands or damages of any kind whatsoever with respect to
the Service, and any information, content, advertisements or products
provided or distributed through the Service including, without
limitation, direct, indirect, incidental or consequential loss
or damages, whether arising from loss of profits, loss of revenue,
loss of data, loss of use or otherwise and whether or not the
possibility of such loss has been notified to I-MediCure. The
foregoing will apply whether such claims, loss or damages arise
in tort, contract, negligence, under statute or otherwise. If
you are a consumer your statutory rights, if any, are not affected.
6. Exclusions
and Limitations
Some jurisdictions do not allow the exclusion of certain warranties
or the limitation or exclusion of liability for incidental or
consequential damages. Accordingly, some of the above limitations
of section 5 may not apply to you.
In particular, nothing in these Conditions shall affect the statutory
rights of any consumer or exclude or restrict any liability for
death or personal injury arising from the negligence or fraud
of I-MediCure.
7. General information
These Conditions (including the guides and rules referred to herein)
constitute the entire agreement between you and I-MediCure and
govern your use of the Service, superseding any prior agreements
between you and I-MediCure. The Conditions and the relationship
between you and I-MediCure shall be governed by the laws of England.
You and I-MediCure agree to submit to the exclusive jurisdiction
of the English courts. Any failure by I-MediCure to exercise or
enforce any right or provision of the Conditions shall not constitute
a waiver of such right or provision. If any provision of the Conditions
is found by a court of competent jurisdiction to be invalid, the
parties nevertheless agree that the court should endeavour to
give effect to the parties' intentions as reflected in the provision,
and the other provisions of the Conditions remain in full force
and effect.
8. Discussion
forums
The material contained in the I-MediCure Discussion Forums is
submitted by the general public, NOT by our medical team, and
is presented to a non-medical audience for discussion purposes
only.
The material presented in the I-MediCure Discussion Forums is
in no way intended to replace professional medical care or attention
by a qualified practitioner. I-MediCure strongly advises all users
with health problems to consult a doctor. You are strongly advised
to consult a doctor before starting any treatment.
The materials in the I-MediCure Discussion Forums cannot and should
not ever be used as a basis for diagnosis or choice of treatment.
To the fullest extent possible, I-MediCure expressly excludes
all liability in respect of the information and opinions contained
in the Discussion Forums, the Service, or any sites linked to
the Service.
I-MediCure makes no representations about the materials in the
Discussion Forums, the Service or any sites linked to the Service.
The Service shall be governed by and construed in all respects
in accordance with English Law and the exclusive jurisdiction
of the English High Court will apply as regards any claim or matter
arising in respect of this Web site. I-MediCure reserves the right
to remove all material which we consider inappropriate. It is
expressly forbidden to post material which is pornographic, offensive,
defamatory, harassing, infringing, undocumented factually incorrect
or otherwise unlawful or illegal, or to post material(s) that
is/are in any way contrary to accepted morality and behaviour.
The Discussion Forums are managed by Discussion Editors who do
not form part of our medical team.
I-MediCure does not monitor the content of the Discussion Forums
and I-MediCure makes no representations as to the medical or other
content of posts onto the Service.
9. Violations
I-MediCure recommends users who find inappropriate content to
contact us immediately in order
I-MediCure may take such action as we in our sole discretion deem
fit, including removing any content. In addition, we reserve the
right and the Discussion Editors are authorised to remove any
material of which they are aware which infringes these terms of
use of the Discussion Forums or which we otherwise consider inappropriate.
Your use of the site, the Service and the
content is subject to the above conditions. If you find these Conditions
unacceptable, we request that you leave the site.
